We Are Social B.V. (We Are Social) collects personal information about you from https://wearesocial.com/nl/, (Website) as provided by you by any other means. Personal information is collected in order to respond to enquiries, provide you with newsletters and electronic newsletters and to provide you with certain content, products and services and, unless you opt-out or unsubscribe, contact you in the future with information on products and services and to provide you with marketing materials via electronic messages (email) or any other form of electronic, emerging, digital or conventional communications channel whether existing now or in the future. 

Our Privacy Policy below contains information about how you can access and correct your personal information, how you can lodge a complaint regarding the handling of your personal information and how any complaint will be handled by We Are Social.   1. We Are Social B.V. (“We Are Social” or “We/we” or “Our/our” or “Us/us”) are committed to respecting the privacy of your personal information. This Privacy Policy explains how we deal with your personal information that we collect, use, hold or process.
  2. We will update this Privacy Policy from time to time when we change how we deal with personal information. We will post any changes to this Privacy Policy on our Websites, so we encourage you to check this Privacy Policy from time to time. In case of substantial changes to this Privacy Policy, we will make sure that we actively provide you with the new version.
  3. In addition to the provisions of this Privacy Policy, there will also be specific and additional privacy and consent provisions that apply to certain collection channels of personal information.   1. No-one is obliged to provide personal information. However, failure to do so may result in We Are Social being unable to provide you with We Are Social’s services, information, upcoming opportunities, events or product information, and other content, including where requested by you.

FOR WHAT PURPOSES DOES WE ARE SOCIAL COLLECT, HOLD, AND USE YOUR PERSONAL INFORMATION?

  1. Personal information that We Are Social collects will be used for the following primary purposes:

Marketing

  1. to provide you with early access to new releases, exclusive events, newsletters, events, activations of We Are Social;
  2. to otherwise market to you (with direct marketing materials), via any medium including mail, or any other form of electronic, emerging, digital or conventional communications channel;

The personal information that will be processed for these purposes includes your name, contact details and other information that you have provided to us.

We will process the personal information based on your consent (e.g. your consent to receive marketing materials). We will process the personal information until you withdraw your consent. Below (in paragraph 23) you may find information on how to withdraw your consent.

Miscellaneous

  1. to share personal information with our group companies and their related bodies corporate and agents, and other trusted third parties in the manner described in this Privacy Policy;
  2. to undertake recruitment for We Are Social (if applicable);
  3. to carry out our obligations and/or interests in the context of an acquisition, sale, merger or transfer of our business or our assets; and

We Are Social group companies (and their directors, servants and agents) may contact you via email or any other form of electronic, emerging, digital or conventional communications channel using the information provided in order to contact you in respect of the primary purposes for collection of personal information as stated above.
  2. We Are Social does not send advertising or marketing information without obtaining prior consent, unless it is otherwise lawful to do so. If you receive communications from We Are Social which you do not wish to receive, you may remove your name from the database either by using the functional unsubscribe facility (if the communication is via commercial electronic message) or by contacting We Are Social‘s Privacy Officer as described above. Please allow 30 days for this request to be processed.

HOW DO WE SHARE YOUR PERSONAL INFORMATION?

We Are Social employees, data processors and other trusted third parties are obliged to respect the confidentiality of any personal information held by We Are Social. However, security of communications over the Internet cannot be guaranteed, and therefore absolute assurance that information will be secure at all times cannot be given. We Are Social will not be held responsible for events arising from unauthorised access to personal information except to the extent required by the relevant privacy laws.
  2. The recipients of your personal information will be located in the European Union (Spain, Ireland, France, Italy, Germany), or overseas.
  3. For individuals in the EU, please note that the recipients of your personal information will be located in countries in which the privacy or data protection laws differ from those of the European Union. HOW DO WE HOLD, AND HOW LONG DO WE HOLD YOUR PERSONAL INFORMATION?

SECURITY

We Are Social takes appropriate security measures to keep personal information secure and to prevent unauthorised access, disclosure, modification, misuse, interference or loss of personal information. We Are Social, its employees and its subcontractors are obliged to respect the confidentiality of any personal information held by We Are Social.
  2. We Are Social also takes reasonable steps to keep personal information accurate, up to date, complete and relevant. We Are Social takes reasonable steps to ensure only those necessary have access to your personal information. Personal information is stored on secure servers that are protected in controlled facilities. This service will be performed on our behalf and data will be hosted by our selected data storage providers. In some cases these facilities will be overseas, including in Ireland as described above. We Are Social retains your information only for as long as necessary for the purposes listed in this Privacy Policy. We Are Social will inform you about serious data breaches in accordance with the GDPR.

YOUR PRIVACY RIGHTS

  1. You have a number of rights under the Nethelands Privacy Law and the GDPR. These include:
    1. (access) to request access to your personal information from us, in a commonly used electronic format. On a case by case basis, We Are Social may determine that it is not legally required to give an individual access to personal information, in which case We Are Social will provide you with a written notice of its refusal to provide access;
    2. (correction) to request that we correct your personal information;
    3. (withdrawing consent) to withdraw your consent for us to use your personal information. Please note that you can also opt-out of online marketing communications at any time by using the unsubscribe feature in each electronic commercial message; and
    4. (complaint) to complain about a breach of the Dutch Privacy Principles.

    4. (complaint) to lodge a complaint in relation to our processing of your personal data with a data protection supervisory authority under the GDPR.

Please allow for a reasonable amount of time for us to process your request, which will generally be up to 30 days. If needed, we may however extend the period in which we respond with two further months. In such event, we will inform you within 30 days after receipt of your request and explain why the extension is necessary.

ANONYMITY AND PSEUDONYMITY

  1. Where practicable, We Are Social will allow you to deal with us on an anonymous or pseudonymous basis. If this is practicable, our Website will only seek information in this way. However, where it is not practicable for the purposes for which information is collected, we will seek the personal information identified above. It will not be practicable to deal with you on an anonymous or pseudonymous basis when we wish to send you direct marketing materials or need to provide you with goods or services requested by you.

WHAT ABOUT ‘COOKIES’?

  1. Cookies are small files which are sent to your computer, smartphone or other device automatically from a web server whenever you visit a particular website. Our Website uses cookies, much like most others but, specifically, we use Google Analytics which, via cookies, helps us to analyse how visitors use our Website.
